THIS SOFTWARE AGREEMENT IS A LEGAL AGREEMENT BETWEEN YOU (WETHER INDIVIDUAL OR ORGANIZATION) AND ICT INNOVATIONS, YOU READ IT CAREFULLY BEFORE USING ICT INNOVATIONS’S SOFTWARE , IT PROVIDES A LICENSE TO USE THE SOFTWARE AND CONTAINS TERMINATION, WARRANTY AND LIABLITY INFORMATION , BY USING SOFTWARE YOU ARE BOUND BY TERMS AND CONDISTIONS OF THIS AGREEMENT , IF YOU DO NOT AGREE WITH TERMS AND CONDISTIONS OF THIS AGREEMENT THEN IMMEDIATLY STOP USING THE SOFTWARE AND REMOVE IT FROM YOUR SERVERS

Definitions

(a) “ICT INNOVATIONS” means ICT Innovations Multan Pakistan.
(b) “USER” means the individual or organization using ICT INNOVATIONS’S software or entering into this agreement.
(c) “Licensed Servers” means the servers having public Internet Protocol Address that USER have provided to ICT Innovations and ICTBroadcast Software has been installed on it.
(d) “ICTBroadcast Software” Means software developed and copyright by ICT Innovations provided to “USER” under this agreement .

1. License Grants

The licenses granted are subject to the terms and conditions set forth in this agreement:
USER is granted a non-exclusive license to use the ICTBroadcast Software for his or his company needs.
USER may install and use the software only on the licensed servers. USER may not install or use the software on any other server other than the licensed servers.
In order to install software on others servers, USER has to get license from ICT Innovations for each individual and virtual private server.
USER License rights under this agreement are non-exclusive and non-transferable unless otherwise agreed by ICT Innovations.

2. License Restrictions

USER can not redistribute , reverse engineer , recompile, disassemble, copy or electronically transfer the Software from one computer to another nor transfer ownership of software to third party.
USER agreed to provide ssh root access of his Licensed servers to ICT Innovations.

3. Support Services

ICT Innovations will provide USER technical support services regarding ICTBroadcast functionality, Please contact ICT Innovations Support Services in case of bug fixing, update , software error or any other issue related to software .

4. Copyrights

All copyrights, title and other intellectual property rights in the ICTBroadcast Software are owned by ICT Innovations . USER is authorized to use the Licensed Software subject to the terms and conditions set out in this document .

5. Compliance with Law

USER agree that in operating the ICTBroadcast Software USER will comply with all applicable international, national, state, regional and local laws and regulations, including, without limitation, privacy, copyright, export control and obscenity law. Any use of the ICTBroadcast software which is illegal under international or local law is forbidden by this EULA.

6. Payments

ICT Innovations reserve right to change ICTBroadcast Software pricing anytime without prior notice. USER agree to pay annually price as agreed or mentioned in ICT Innovations web site , if USER fail to comply with payments within due date, USER right to use this software will automatically will be terminated.

7. Term and Termination

In the event that USER fail to comply with any of the terms or conditions of this EULA, ICT Innovations may immediately terminate this EULA with or without notice. USER agree to permanently remove ICTBroadcast software from his servers immediately in case of termination of this EULA.

8. Limited Warranty and Disclaimer

THE SOFTWARE LICENSED HEREUNDER IS PROVIDED “AS IS” AND ICT Innovations HEREBY DISCLAIMS ALL OTHER WARRANTIES AND REPRESENTATIONS, WHETHER EXPRESS, IMPLIED, OR OTHERWISE, INCLUDING THE WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. ALSO, THERE ARE NO WARRANTIES OF NON-INFRINGEMENT, TITLE OR QUIET ENJOYMENT. ICT Innovations DOES NOT WARRANT THAT THE SOFTWARE IS ERROR-FREE OR WILL OPERATE WITHOUT INTERRUPTION. NO RIGHTS OR REMEDIES REFERRED TO IN ARTICLE 2A OF THE UCC WILL BE CONFERRED ON USER UNLESS EXPRESSLY GRANTED HEREIN. THE SOFTWARE IS NOT DESIGNED, INTENDED OR LICENSED FOR USE IN HAZARDOUS ENVIRONMENTS REQUIRING FAIL-SAFE CONTROLS, INCLUDING WITHOUT LIMITATION, THE DESIGN, CONSTRUCTION, MAINTENANCE OR OPERATION OF NUCLEAR FACILITIES, AIRCRAFT NAVIGATION OR COMMUNICATION SYSTEMS, AIR TRAFFIC CONTROL, AND LIFE SUPPORT OR WEAPONS SYSTEMS. ICT Innovations SPECIFICALLY DISCLAIMS ANY EXPRESS OR IMPLIED WARRANTY OF FITNESS FOR SUCH PURPOSES.

9. Limitation of Liability

(a) ICT Innovations SHALL NOT BE LIABLE TO USER OR ANY THIRD PARTY FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, COVER OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR THE INABILITY TO USE EQUIPMENT OR ACCESS DATA, LOSS OF BUSINESS, LOSS OF PROFITS, BUSINESS INTERRUPTION OR THE LIKE), ARISING OUT OF THE USE OF, OR INABILITY TO USE, THE SOFTWARE AND BASED ON ANY THEORY OF LIABILITY INCLUDING BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF ICT Innovations OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

10. Third-Party Software

This agreements covers only software developed by ICT Innovations and does exclude other third party software including open source software required to run ICTBroadcast
